  • Important Notice from the Govenment Site: 
    Every Debtor must obtain budget and credit counseling from an accredited counseling agency BEFORE filing a bankruptcy petition. Bankruptcy Code § 109(h). The counseling must have been completed not more than 180 days before the day you file your bankruptcy petition. (Source: www.orb.uscourts.gov )
  • Federal Laws and State Laws
    While the primary rules and regulations as well as the framework for bankruptcy protection are governed by federal laws, each Judicial district has it's own bankruptcy court which may have varying forms and detailed rules for the structure and process of a bankruptcy filing. According to "Bankruptcy Basics" from the US Government: "Article I, Section 8, of the United States Constitution authorizes Congress to enact “uniform Laws on the subject of Bankruptcies.” Under this grant of authority, Congress enacted the “Bankruptcy Code” in 1978. The Bankruptcy Code, which is codified as title 11 of the United States Code, has been amended several times since its enactment. It is the uniform federal law that governs all bankruptcy cases." It is the combination of Federal Bankruptcy code and local bankruptcy rules that govern how an individual must fulfill this process. Due to the many complexities in each location, it is strongly advised that petitioners use a local attorney to prepare their paperwork and guide them through this process.
  • Discharge of Debts
    The primary purpose for a bankruptcy filing is to provide for the discharge of debts for which the debtor no longer has any means to repay. Not all debts may be discharged, but they are determined by the type of filing and the Federal code relating to that filing. The timing of discharge may vary but with chapter 7 filings, debts are typically discharged promptly. Bankruptcy generally requires the liquidation of all non-exempt assets and that a trustee manage this process and pay out the proceeds to petitioning creditors. Once a debt has been discharged, the creditor may no longer make any attempt to collect on this debt.
